A.N.S. warrants that any goods sold by it will be of merchantable quality at the time of shipment.

A.N.S. 's liability under this warranty is limited to the replacement of the goods or, at its option, a complete refund of the purchase price. You must notify A.N.S. within 10 days of delivery of any goods, which you believe, do not comply with this warranty. This warranty is in lieu of all other warranties, rights or obligations, expressed or implied, arising by statute or otherwise, including the implied warranties arising under the Sales of Goods Act (Ontario) or equivalent legislation in any other jurisdiction. A.N.S. 's liability is strictly limited to the replacement of the defective goods or the refund of the purchased price. A.N.S. shall not otherwise be liable in any way whether based on warranty, contract, and negligence or otherwise, and this limitation of liability shall apply, even in the event of a fundamental breach of contract. In no event shall A.N.S. be liable for any direct, indirect, special or consequential damages.
